Moscow. On October 16, the Moscow District Military Court reviewed the appeal of the defense in the case of the Russian oppositionist Alexei Navalny, sentenced to three and a half years in a colony for violating parole conditions. The court upheld the sentence. The defendant was not allowed to attend the hearing. The trial was closed to the public.

The judge said that the defense had not provided any evidence of violation of the parole conditions by the penitentiary authorities, nor had they appealed to the investigative bodies to clarify the circumstances of the incident, and that they had not presented any evidence that the parole terms had been changed without the defendant's consent.

The defense had argued that the violation of parole conditions had occurred as a result of a deliberate decision by the penal colony administration to deprive Navalny of his freedom before the expiration of his sentence, and that the investigative bodies had failed to take proper measures to prevent this.

The court also rejected the defense's request to annul the decision to place Navalny in a colony with a strict regime, finding that there was no evidence of violations of the law in this regard.

Navalny's lawyers have announced their intention to appeal the decision to the Supreme Court of the Russian Federation. They have also expressed their concern that their client's health and safety are at risk in the colony.

Navalny was arrested in January 2021 upon his return to Russia from Germany, where he had been recovering from a nerve agent poisoning. He was sentenced to two years and eight months in prison for violating the terms of a suspended sentence in a previous case. The sentence was later increased to three and a half years due to new charges of parole
